Please read these Terms of Use ("Terms of Use" or "Terms") before using the services offered by dealsnapt inc., its mobile application Snaptown, and its website at https://dealsnapt.com (collectively "Snaptown"). By using or visiting Snaptown, you expressly agree to be bound by these Terms and all applicable laws and regulations governing Snaptown®. You are advised to periodically check the website for changes in the Terms of Use agreement.

Definitions
“Voucher” is a prepaid offer that a purchaser buys ahead of time.
“Merchant Offering ” means the goods and/or services to be provided by the Merchant, specified on the Voucher as presented by Snaptown®.
“Promotional Period” means the period during which Vouchers for the Merchant Offering are available for purchase within Snaptown.
“Full Offer Value” means the Amount Paid plus the Promotional Value.
“Amount Paid” means the amount a purchaser pays for each Voucher.
“Promotional Value” means the portion of the Full Offer Value that exceeds the Amount Paid.
“Promotional Value Expiration Date” means the date when the Promotional Value expires as specified on the Voucher. It is the date after which the Voucher may only be redeemed for the Amount Paid.
Description of Service Snaptown® provides a platform that enables information and interest exchange for the smartphone and web user communities around merchant deals (referred to hereafter as "the Service") subject to the following Terms of Use. Snaptown® uses reasonable efforts to ensure that the Service is available on a 24/7 basis. However, there will be occasions when the Service will be interrupted for maintenance, upgrades and emergency repairs or due to failure of equipment that are beyond the control of Snaptown®and its owners. By using the Service in any way, you are agreeing implicitly or explicitly to comply with the Terms of Use set forth within as they may be updated from time to time.

Acceptance of Terms
By using the Service you agree that it shall not be liable to you for any modification, suspension or discontinuance of the Service. Snaptown® reserves the right, at its sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such modifications shall become effective immediately upon the posting thereof. Snaptown® may terminate the Service, for any reason, and without notice, without liability to you, any other user or any third party. You are advised to periodically check this website and review this agreement on a regular basis to keep yourself apprised of any changes. Should you object to any term or condition of the Terms of Use, any guidelines, or any subsequent modifications thereto or become dissatisfied with Snaptown® in any way, your only recourse is to immediately discontinue use of the Service.
Content
All materials created, contributed, retrieved or published to the Service by any user of the Service shall be referred to herein as "Content." By communicating with the Service, you have provided consent to share information, opinions, advice, tips, warnings, etc. in the form of written and/or shared posts on Snaptown's® platform. You may publish posts to the Snaptown® platform, so long as the content is not - illegal, obscene, defamatory, hateful, invasive of privacy, or features referral codes. Snaptown® reserves the right to, but has no obligation to, remove Content and block user accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use. You represent and warrant that you own or otherwise control all of the rights to the content that you submit to Snaptown®; that use of the Content you supply does not violate this policy and will not cause injury to any person or entity. Snaptown attempts to maintain a platform that is absent of offensive, indecent or objectionable Content. Snaptown® does not guarantee the accuracy, integrity, or quality of any of the Content, and we make no representations or warranties of any kind about the Content. You understand that by using Snaptown®, you may be exposed to this Content. Under no circumstances will Snaptown® be liable in any way for any Content, including, but not limited to, the subject matter of any Content, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content published, emailed, transmitted or otherwise made available via Snaptown® platform or website. Snaptown® claims no ownership interest in the user Content. You acknowledge and agree that if you contribute any Content, you grant to Snaptown a perpetual, non exclusive worldwide, royalty-free, transferable right and license to use in any way such user Content (including all related intellectual property rights) to provide the Service.

It is our goal to make the use of our Service a good experience for all of our users, so you agree not to do any of the following:
Age Requirements and Limitations on Use of the Service
Users of the Services must be at least 13 years of age. Children under the age of 13 are not permitted to use the Service, and no information from children under the age of 13 will be knowingly collected by Snaptown®. Users agree not to attempt to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or any other means. Users agree not to create a false identity or otherwise attempt to mislead others as to the identity of the sender or the origin of Content. User agrees to only enter email addresses that are controlled by or under the common control of that User. If Snaptown® finds email address information that Snaptown® suspects to be false, inaccurate, not current or otherwise not under the control of User, Snaptown® has the right to suspend or terminate the Service and refuse any and all current or future use of the Service, or any portion thereof. Users must not abuse, harass, threaten, impersonate or intimidate other Snaptown® users. Users may not use the Service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content. Users must not transmit any worms or viruses or any code of a destructive nature. Users understand and agree that by creating fraudulent accounts in order to improve your standing on Snaptown® is a violation of the Terms of Service. Such violations may subject the user and his or her agents to removal from Snaptown.
Fees
The Service is provided to you free of charge, however you are solely responsible for any fees, charges and expenses incurred by you in accessing and using the Service.
Credits
“Credits” are a form of Snaptown® currency redeemable only toward future Snaptown Voucher purchases. Snaptown® reserves the right to discontinue Credits or modify these terms. To accumulate and redeem Credits, you must create, and maintain in good standing, a Snaptown® customer account registered with a valid credit card. Credits do not expire. Unless required by law, Credits are non-transferrable and are not redeemable for cash.
You can earn Credits by participating in various activities and responding to certain offers (“Qualifying Activities”). In order to earn Credits indicated in the Qualifying Activity materials, you must comply with the terms of the applicable Qualifying Activity. Snaptown® may credit Credits to your account for returns or refunded purchases or other reasons within our customer service team’s discretion.
You are responsible for ensuring that Credits you earn or are awarded as credits are added to your Snaptown® account. Credits may not appear in your account for up to ten business days if a Qualifying Activity must be validated. Credit sin your account will automatically be the first form of credit to be applied toward future Snaptown purchases.
Your Credits cannot be resold. Your Credits cannot be combined or merged with Credits in any other account registered to you or another End User. Access to Credits or related account information may not be sold or distributed to others. You may not use any other End User’s password or account to accrue Credits for that account. Unauthorized or fraudulent use, resale, or distribution of Credit sis prohibited. Snaptown reserves the right to cancel, revoke, or otherwise prevent the issuance of Credits in cases of mistake and in any suspected case of unauthorized or fraudulent use.
Vouchers
Vouchers you purchase through Snaptown as a Snaptown® account holder are special promotional offers that you purchase from participating Merchants through our service. The vouchers are redeemable for certain goods, services or experiences offered by, or facilitated through, the Merchant identified on the voucher ( ‘Merchant Offering’). The Merchant is solely responsible for redeeming the voucher. The Merchant is the issuer of the voucher and is fully responsible for all goods and services it provides to you and for any and all injuries, illnesses, damages, claims, liabilities and costs (“Liabilities”) it may cause you to suffer, directly or indirectly, in full or in part, whether related to the use or redemption of a voucher or not. You waive and release SnaptownTMand its subsidiaries, affiliates, partners, officers, directors, employees and agents from any Liabilities arising from or related to any act or omission of a Merchant in connection with your use of a voucher or the services/goods it provides in connection with it.
By purchasing any voucher you agree to the terms of this Agreement. By purchasing, viewing a mobile version, printing, accepting, using or attempting to use any voucher, you agree to these Terms of Sale specifically (“rules”) the terms on the voucher itself and any additional, deal specific terms advertising the voucher at the time of purchase (collectively, the “fine print”regardless of how labeled). These rules apply to all promotional vouchers that we make available, unless a particular voucher’s fine print states otherwise, and except as otherwise required by law. In the event of a conflict between these rules and a voucher’s fine print, the voucher’s fine print will control.
Snaptown® is a service provider for the Merchant identified on the voucher and the Merchant is the sole issuer of the voucher. Vouchers have two separate values: (a) the “amount paid” and (b) the promotional value. The “promotional value” is the additional value beyond the amount paid. Together, the amount paid and the promotional value equals the “full offer value” of the voucher. For example, if you pay $20 for a voucher that gets you $50 of goods or services from a Merchant, the full offer value is $50, the amount paid is $20 (this amount does not expire until it is used or is refunded), and the promotional value is $30 (this amount expires on the date stated on the voucher unless expiration of the promotional value is prohibited by law – “promotional value expiration date”).
If a Merchant or venue refuses to honor any voucher, Snaptown® will refund the amount paid upon request in the original form of payment. Vouchers are not redeemable for cash, unless required by law. Unauthorized or unlawful reproduction, resale, modification or trade of vouchers is prohibited.
Voucher Restrictions
Except as otherwise stated on a Voucher or required by law, the following terms and conditions apply to all Vouchers from all Merchants:
Voucher Refunds
Snaptown® will always offer a full refund or credit of the Amount Paid on all non-expired, unused Vouchers within forty eight (48) hours of their purchase by you unless explicitly stated otherwise in a particular deal’s restrictions. Requests for refunds after forty eight (48) hours are at the sole discretion of the Merchant providing the products or services described in the Voucher. In addition, Snaptown will always honor your request for a refund of the Amount Paid of any unredeemed Voucher if the Merchant goes out of business before the Promotional Period expires.
This Refund Policy is in addition to any rights that you may have under applicable law.
Privacy and Information Disclosure
Your use of the Service or the Snaptown® website, mobile websites, and mobile applications signifies acknowledgement of and agreement to our Privacy Policy. You further acknowledge and agree that Snaptown may, in its sole discretion, preserve or disclose your Content, as well as your information, such as email addresses, IP addresses, timestamps, and other user information, if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: comply with legal process; enforce the Terms of Use; respond to claims that any Content violates the rights of third-parties; respond to claims that contact information of a third-party has been posted or transmitted without their consent or as a form of harassment.
No Spam Policy
You understand and agree that forwarding unsolicited messages and posts whether in bulk or individual form to Snaptown users is expressly prohibited by these Terms of Use. Any unauthorized use of the Snaptown® computer systems is a violation of the Terms of Use and such violations may subject the sender and his or her agents to civil and criminal penalties.
Indemnity
Your interactions with organizations and/or individuals found on or through the Service, including advice, delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You agree to indemnify and hold Snaptown, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, of any sort, including financial loss, attorney fees and court costs made by any third party due to or arising out of Content you publish, retrieve or make available through the Service, your use of the Service, your violation of the Terms of Use, your breach of any of the representations and warranties herein, or your violation of any rights of another. If there is a dispute between users of the Service, or between users and any third party, you understand and agree that Snaptown® is under no obligation to become involved, and shall not be responsible or liable for any loss or damage of any sort. In the event that you have a dispute with one or more other users, you hereby release Snaptown®, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service.
Notification of Claims of Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify Snaptow®n for notice of claims of copyright or other intellectual property infringement at: A good faith statement by you that the disputed use is not authorized by the copyright owner, its agent, or the law; A description of the copyrighted work or other intellectual property that you claim has been infringed; A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner; Your name, address, telephone number, and email address. Upon receiving your complaint, Snaptown® may, in its sole discretion, remove the Content that you believe infringes your copyright. In addition, Snaptown may block the use of the Service to the user who appears to be infringing your intellectual property rights.
Forum of Choice of Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of the Service shall be filed only in the federal courts located in the State of California, or state courts located in the county of Sacramento and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.

- are solely responsible for your Content submissions, including discussion posts, profile information and links, pictures, and other such content;
- represent that you own or have the necessary licenses, rights, permissions, and consents to use and authorize Snaptown® to use any and all Content submitted by you to Snaptown® in accordance with the licenses granted in this Agreement;
- hereby grant each Snaptown® user, whether using Snaptown® or an application authorized by Snaptown® but developed via a third-party developer, a non-exclusive license to access the Content you submit through Snaptown® and to use, reproduce, distribute, prepare derivative works of, display and perform such Content as permitted through Snaptown's functionality and under these Terms of Service;
- will not submit Content that is copyrighted or subject to third party proprietary rights, including privacy, publicity, trade secret, etc., unless you are the owner of such rights or have the appropriate permission from their rightful owner to specifically submit such Content to Snaptown; and
- hereby affirm we have the right to determine whether any of your Content submissions are appropriate and comply with these Terms of Service, remove any and/or all of your submissions, and terminate your account with or without prior notice.

- impersonate another user.

Voucher Restrictions
Except as otherwise stated on a Voucher or required by law, the following terms and conditions apply to all Vouchers from all Merchants:
- Vouchers cannot be combined with any other coupons, discounts, or promotions.
- If an expiration date for the promotion is stated, then the Promotional Value expires on the expiration date.
- Vouchers are not redeemable for cash, except as required by applicable law.
- Vouchers cannot be sold or transferred.
- No refunds, cash back, or credit will be issued for the Promotional Value.
- In the event you partially use the Promotional Value, your redemption of the purchase of Merchant's products or services will be allocated by the Merchant against the Amount Paid first, and then against the Promotional Value. No refunds, cash back, or credit will be issued for any partially used Promotional Value.
- Neither Snaptown nor the Merchant will be responsible for lost or stolen Vouchers.
- Vouchers may not be duplicated and can only be redeemed once. Any such duplicates are null and void.
- Vouchers or the Promotional Value cannot be used for taxes, tips, prior balances, or shipping or handling charges that might be imposed, where applicable, unless otherwise specified in the Restrictions.
- Use of Vouchers for alcoholic beverages is at the Merchant's discretion in accordance with applicable laws
Voucher Refunds
Snaptown® will always offer a full refund or credit of the Amount Paid on all non-expired, unused Vouchers within forty eight (48) hours of their purchase by you unless explicitly stated otherwise in a particular deal’s restrictions. Requests for refunds after forty eight (48) hours are at the sole discretion of the Merchant providing the products or services described in the Voucher. In addition, Snaptown will always honor your request for a refund of the Amount Paid of any unredeemed Voucher if the Merchant goes out of business before the Promotional Period expires.
This Refund Policy is in addition to any rights that you may have under applicable law.
Privacy and Information Disclosure
Your use of the Service or the Snaptown® website, mobile websites, and mobile applications signifies acknowledgement of and agreement to our Privacy Policy. You further acknowledge and agree that Snaptown may, in its sole discretion, preserve or disclose your Content, as well as your information, such as email addresses, IP addresses, timestamps, and other user information, if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: comply with legal process; enforce the Terms of Use; respond to claims that any Content violates the rights of third-parties; respond to claims that contact information of a third-party has been posted or transmitted without their consent or as a form of harassment.
No Spam Policy
You understand and agree that forwarding unsolicited messages and posts whether in bulk or individual form to Snaptown users is expressly prohibited by these Terms of Use. Any unauthorized use of the Snaptown® computer systems is a violation of the Terms of Use and such violations may subject the sender and his or her agents to civil and criminal penalties.
Indemnity
Your interactions with organizations and/or individuals found on or through the Service, including advice, delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You agree to indemnify and hold Snaptown, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, of any sort, including financial loss, attorney fees and court costs made by any third party due to or arising out of Content you publish, retrieve or make available through the Service, your use of the Service, your violation of the Terms of Use, your breach of any of the representations and warranties herein, or your violation of any rights of another. If there is a dispute between users of the Service, or between users and any third party, you understand and agree that Snaptown® is under no obligation to become involved, and shall not be responsible or liable for any loss or damage of any sort. In the event that you have a dispute with one or more other users, you hereby release Snaptown®, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service.
Notification of Claims of Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify Snaptow®n for notice of claims of copyright or other intellectual property infringement at: A good faith statement by you that the disputed use is not authorized by the copyright owner, its agent, or the law; A description of the copyrighted work or other intellectual property that you claim has been infringed; A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner; Your name, address, telephone number, and email address. Upon receiving your complaint, Snaptown® may, in its sole discretion, remove the Content that you believe infringes your copyright. In addition, Snaptown may block the use of the Service to the user who appears to be infringing your intellectual property rights.
Forum of Choice of Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of the Service shall be filed only in the federal courts located in the State of California, or state courts located in the county of Sacramento and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
